To restrict the movement of people and, therefore, limit the spread of the coronavirus, judge Anderson de Paiva Gabriel, on judicial duty, ordered this Sunday (12/4) that the websites Booking and Airbnb do not allow reservations in hotels, inns and hostels, nor the rental of houses in Paraty (RJ) until April 30th.

The municipality of Paraty filed a public civil action against the platforms. According to the entity, companies continue to offer accommodation in the city, which makes control measures against the Covid-19 pandemic difficult.
In his decision, judge Anderson de B2B Lead Paiva Gabriel pointed out that the state of Rio de Janeiro imposed a series of coronavirus prevention measures on hotels. And Paraty, through Municipal Decree 33/2020, suspended these activities.
For the judge, the temporary shutdown of these services is a health defense matter of local interest. Therefore, the municipality can complement federal and state legislation on the subject.
However, the judge highlighted that it would not be reasonable to force Booking and Airbnb to exclude all accommodation offers in Paraty from their websites while the risk and emergency situation lasts. After all, not allowing reservations in the medium term could put the financial health of several establishments at risk.
Thus, Anderson Gabriel granted an injunction in part to prohibit platforms from allowing reservations only while Municipal Decree 33/2020 is in force. It has already been extended once, and for now, it will be valid until April 30th.
In a statement, Airbnb informed that "it will act in compliance with the court decision of April 12, 2020 that determined the prohibition of new reservations in Paraty during the entire period of validity of decrees 33/2020 and 36/2020".
At the time of publishing this report, it was still possible to book rooms in Paraty in April on Booking and Airbnb.
